By agreeing to these Terms of Use, which is required before you will be able to use the benefits offered by this site, you acknowledge that you have carefully read and understand each of the terms and conditions specified below. You also understand that these terms and conditions may be changed periodically and that you are required to re-read the terms and conditions so as to remain fully aware of any such changes. For reference purposes, parties placing advertisements on this site of rental properties available will be referred to as “Advertiser(s)” and parties utilizing this site to locate and gather information about prospective rental properties will be referred to as “Site User(s)”.

1. No Minors: If you are under the age of 18, you are not allowed to utilize this site, either as an Advertiser or Site User.
2. Not a Brokerage or Rental Company: VacationMLS.com is not a real estate broker, agent, or rental company and does not receive commissions from any of the Advertisers or Site Users utilizing this site.
3. No Warranty as to Accuracy of Listings: VacationMLS.com does not and will not investigate or confirm any of the information provided by the Advertisers and, therefore, does not warrant the accuracy of any of such information. Advertisers are responsible for all of the information provided and the accuracy thereof. Confirmation of this information is the sole responsibility of the Site User.
4. No Warranty as to Information provided by Renters: VacationMLS.com does not and will not investigate or confirm any of the information provided by Site Users and, therefore, does not warrant the accuracy of any of such information. Confirmation of this information is the sole responsibility of the Advertiser.
5. Advertiser Accuracy: Regardless of the source, Advertisers certify that the information provided in any listing, including any pictures provided, are of their own property, or property that they contractually represent, and that they have the right to publish said information.
6. Termination or Inactivation of Listings: VacationMLS.com listings are for 12 month intervals, but may be terminated at any time. No refunds will be given on any listing that is terminated, regardless of the time elapsed from listing date until termination. Further, an inactivation of a property during the term of its listing will not cause the term to be lengthened for the time of inactivation. The transfer of a listing from a property that is sold to one not previously listed will allowed upon payment of a $25 transfer fee.
7. Acceptable Content/Right to Remove Listings: VacationMLS.com desires to preserve a “family safe” environment as to the listings contained herein and, therefore, reserves the right to remove any listing, or the objectionable part of any listing, and to cancel the rights of any Site User without notification, refund or credit. To that end, a listing may not contain information that would be reasonably considered vulgar, sexual in nature, or otherwise offensive to a member of the general public. VacationMLS.com shall be the sole arbiter as to the content contained in any listing.
8. Indemnification: Advertisers and Site Users agree to indemnify and hold VacationMLS.com harmless from any loss, cost, damage or expense, including attorneys’ fees and court costs) which it may incur as a result of either’s (i) violation of these Terms of Use or (ii) misrepresentations or failures to disclose information by one to the other related to any contractual or proposed contractual relationship between them.
9. Rental Cancellations and Refunds: VacationMLS.com has no authority as to the setting or enforcement of cancellation or refund policies for the properties listed. It is the sole responsibility of the Advertiser to set and enforce such policies or to negotiate any modification of such policies. It is the sole responsibility of Site Users to become informed as to such policies and to seek the enforcement or waiver of any such policy.
10. Unsolicited Commercial E-Mail or Spam: The use of information on this site for the distribution of commercial e-mail or spam is a violation of the Terms of Use and our copyright. In addition to canceling the privileges of any Site User who engages in any such activity, VacationMLS.com will also seek criminal prosecution of those Site Users.
11. License to Use Information Provided: By submitting information to or through this web site, Advertisers and Site Users are licensing the use of the information so provided for the intended use.
12. Waiver for Harm to Computers: VacationMLS.com disclaims all liability for damage suffered to any computers used to access this web site and anyone using computers who suffer any such damage waive any claims that they might have resulting from any transmissions from this web site, including, but not limited to, viruses or worms or the downloading of information beyond the capacity of the receiving computer to receive and process such information.
13. Disputes: In the event any dispute arises that involves the owner of this web site, the Advertiser or Site User claiming the dispute agree that the dispute shall be resolved by binding arbitration. Such arbitration shall be conducted by, and in accordance with the rules of, the American Arbitration Association and any hearing conducted shall be done in Nashville, Tennessee. The governing law as to the resolution of any disputes shall be the law of the State of Tennessee and jurisdiction and venue for any matters submitted to a court of law shall reside in Davidson County, Tennessee or the United States Court for the Middle District of Tennessee.
